Terms of Service

These Terms of Service ("Terms") govern your access to and use of Telestrator Live (the "Service"). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of an organization, you represent that you are authorized to do so.

1. The Service

Telestrator Live is a hosted tool for drawing over on-screen graphics in real time, controlled from a booth and drawn from an iPad. We may update, improve or modify the Service over time.

2. Accounts

You are responsible for the activity under your account and for keeping your login credentials secure. Notify us promptly of any unauthorized use. You must provide accurate information and be at least the age of majority in your jurisdiction.

3. Subscriptions, trials and billing

• The Service is offered on a subscription basis. Current pricing is shown on our site (presently $29/month) and may change with notice.
• Free trials run for the stated period (presently 7 days). If you do not subscribe, your access may become limited when the trial ends.
• Paid subscriptions renew automatically each billing period until cancelled. You can cancel at any time, effective at the end of the current period.
• Except where required by law, payments are non-refundable. Payments are processed by Stripe; by subscribing you also agree to Stripe's terms.

4. Your content

You retain all rights to the graphics, images, video and text you upload ("Your Content"). You grant us a limited license to host, process and display Your Content solely to operate the Service for you. You are responsible for ensuring you have the rights to use Your Content and that it does not infringe others' rights or violate any law.

5. Acceptable use

You agree not to misuse the Service, including by: uploading unlawful or infringing material; attempting to disrupt, reverse engineer, or gain unauthorized access to the Service; reselling the Service without authorization; or using it to harm others.

6. Self-hosted and third-party services

The Service relies on third-party providers (such as Supabase, Cloudflare, Stripe and Fly.io). Their availability is outside our control. Any separately offered self-hosted option is governed by the license terms provided with it.

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, Telestrator Live will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

9. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate access if you breach these Terms or if necessary to protect the Service or other users. Upon termination, your right to use the Service ends.

10. Changes to these Terms

We may revise these Terms from time to time. When we do, we will update the "Last updated" date, and continued use of the Service after changes take effect constitutes acceptance.
